Any entry onto the chairlift is an acknowledgment and \u003c\/i\u003e\u003ci\u003eacceptance of all of the terms of the following Release of Liability Agreement.\u003c\/i\u003e\u003c\/strong\u003e\u003c\/p\u003e\n\u003cp\u003e\u003ci\u003eRELEASE OF LIABILITY AGREEMENT\u003c\/i\u003e\u003c\/p\u003e\n\u003cp\u003e\u003ci\u003eAs a condition of being permitted to use Tenney Mountain's facilities, premises and equipment, I AGREE \u003c\/i\u003e\u003ci\u003eTO RELEASE FROM LIABILITY, HOLD HARMLESS and IDEMNIFY Tenney Mountain, its parent and \u003c\/i\u003e\u003ci\u003esubsidiary companies, its agents, employees and volunteers, and its real and personal property owners, \u003c\/i\u003e\u003ci\u003ehereafter \"RELEASED PARTIES\", FROM any and all CLAIMS FOR INJURY, DEATH, OR PROPERTY \u003c\/i\u003e\u003ci\u003eDAMAGE, including those caused by the alleged NEGLIGENCE or other fault of RELEASED PARTIES.\u003c\/i\u003e\u003c\/p\u003e\n\u003cp\u003e\u003ci\u003eI agree to assume all risks inherent or otherwise associated with loading, riding and unloading chairlifts and \u003c\/i\u003e\u003ci\u003eany other activities I engage in at Tenney Mountain. I agree that any lawsuit that I bring (or is brought on \u003c\/i\u003e\u003ci\u003emy behalf) against any RELEASED PARTIES must be brought only in the State Courts of Grafton County, \u003c\/i\u003e\u003ci\u003eN.H. and that New Hampshire law shall govern. If any part of this RELEASE OF LIABILITY \u003c\/i\u003e\u003ci\u003eAGREEMENT is deemed unenforceable, all other parts shall remain in full force and effect.
